Age Verification Policy
At Cellar Link Auctions, ensuring that alcohol is sold responsibly and in compliance with the laws of New South Wales is paramount. To this end, we have established a strict age verification policy to prevent underage sales.
1. Condition of Purchase
- Mandatory Age Declaration: All customers must declare that they are of 18 years of Age to enter the website, before accessing the purchasing sections of our website. This declaration is affirmed at the point of sale.
- Proof of Age Requirement: It is a condition of purchase that customers may be asked to provide a valid Proof of Age Card, Driving License, or Passport to verify their age.
2. Methods of Age Verification
- During Purchase: Customers must provide accurate date of birth information during the online checkout process.

Prior to Dispatch: At the point of dispatch we reserve the right to ask customers to present one of the following valid forms of identification if requested by the the store personnel:
- Proof of Age Card
- Driving License
- Passport

Upon Delivery: At the point of delivery, customers must present one of the following valid forms of identification if requested by the delivery personnel:

- Driving License

3. Compliance with NSW Liquor License Verification Requirements
- Training and Procedures: Our staff and delivery personnel are trained to follow strict procedures in age verification, ensuring compliance with NSW Liquor License requirements.
- Refusal of Sale: If a customer fails to provide suitable proof of age when requested, the sale will be refused, and the alcohol will not be delivered.
4. Legal Obligations
- Adherence to Laws: This policy is in accordance with the legal requirements set forth by Liquor & Gaming NSW, ensuring that all alcohol sales are conducted legally and responsibly.
- Customer Cooperation: Customers are required to cooperate with our age verification processes as part of our commitment to responsible alcohol sales.

5. Cancellation Policy should the conditions not be met
Should the customer refuse to provide the required documents under the NSW Liquor Legislation, this will be deemed grounds for the order (goods) to be held until the customer shall provide such documents, so as to allow compliance under our Liquor License. The customer does NOT have an automatic cancellation right if they refuse to provide such documents.
The goods shall be stored for 3 months to allow compliance.
If after 3 months the Customer has not provided such documents, the goods will be considered abandoned under the NSW "Uncollected Goods Act 1995" or the NSW Warehouseman's Lien Act 1935, whichever is most appropriate to the circumstances. All associated fees will be applied and the remainder (if any) will be deposited with the appropriate authorities.
